Hamdan v. Rumsfeld, ___ U.S. ___ (2006)

In the final and perhaps most notable decision of the 2006 term, the United States Supreme Court strongly limited the power of the Bush administration to conduct military tribunals for suspected terrorists imprisoned at the United States Naval base in Guantanamo Bay, Cuba.  In the 5-3 decision, Justice John Paul Stevens, writing for the majority, concluded that the military commission convened to try the petitioner Hamdan lacked the power to proceed because its structure and procedures violated both the Uniform Code of Military Justice and the Geneva Convention.
